Abstract

This review provides a critical analysis of Dr Ghouri’s argument on the applicability of environmental, human rights, and other similar treaties in investment arbitration through the resolution of possible conflicts between such treaties and the applicable Bilateral Investment Treaties (BITs) on the basis of a balance of the different interests and values involved in those treaties and in the BITs.
